Legal Notice & Compliance Policy

1. Who We Are & What We Do
Seshly (“Seshly,” “we,” “us,” “our”) is an online directory and pass facilitation service for private cannabis social clubs and licensed coffeeshops. We are not a cannabis club, dispensary, or vendor. We do not sell cannabis, accessories, or club memberships, and we do not guarantee admission to any venue.
Our role is limited to:
- Publishing club and coffeeshop information sourced from owners or public records
- Issuing digital invitation/access documents confirming a user's expressed interest in visiting a venue, subject to that venue's own rules
- Processing the fee for this digital service
Any membership, donation, admission fee, or admission decision is made exclusively by the club on its own premises under its own policies and applicable law. Our digital pass is not a membership, does not waive venue requirements, and does not include any venue fee.
2. Adults Only — No Encouragement to Consume
This service is intended only for adults (18+ or 21+ where required by local law). Seshly does not promote the consumption of controlled substances and does not provide legal, medical, or health advice.
3. Compliance Statement
We respect applicable laws and jurisprudence concerning private associations. To that end:
- We do not publicly recruit members on behalf of any club
- Any “invite” shown in our product flow is a request to visit and an introductory document, not an entitlement to entry or membership
- Clubs may be marked as “appointment-only” or “members-only,” in which case we limit the flow to informational requests
- We cooperate with club owners who ask to edit, restrict, or remove their listing
4. Fees & What You Are Paying For
When users pay a fee on Seshly, they are paying for our digital service — directory access, routing, and the generation of a non-binding invitation document with arrival instructions. This fee is entirely separate from any venue's own membership or door fee, which if required is paid on-site directly to the venue.
5. Venue Responsibilities & Representations
By claiming or submitting a listing, a venue represents that:
- It is a private association or licensed establishment operating in accordance with applicable law
- All information provided to Seshly is accurate and does not infringe third-party rights
- It will notify us promptly of any changes (hours, rules, closure)
Venues are solely responsible for admission decisions, membership processing, on-site fees, and on-site conduct.
6. Takedown / Do-Not-List Policy
If you are an owner or authorised representative and do not wish to be listed, or if any content is inaccurate or unauthorised:
- Email legal@seshly.com with the club name, proof of control, the URL(s) in question, and the requested action (correct / replace / remove).
- We will unpublish or correct verified items promptly and add your venue to our Do-Not-List registry.
IP infringement notices should also be sent to legal@seshly.com identifying the content, your rights, and the requested action.
7. User Responsibilities
Users must:
- Be legal adults in their jurisdiction
- Provide truthful information during registration and checkout
- Respect each venue's rules (ID, sponsor requirements, on-site membership fee)
- Comply with all applicable local laws
Seshly may suspend or cancel access for misuse or unlawful conduct.
8. Content Sources & Accuracy
Some content is provided by venue owners; other material may come from public sources. We do not guarantee completeness or real-time accuracy. Club policies can change without notice. Always confirm details directly with the venue before visiting.
9. No Agency; Independent Parties
Seshly is not an agent, partner, joint venturer, or employer of any listed venue. We are not a party to any on-site transaction, membership agreement, or donation between a user and a venue.
10. No Legal or Medical Advice
This website and service provide general information only. Nothing here constitutes legal, medical, or compliance advice. We are not a law firm. If you need legal guidance, consult qualified counsel.
11. Disclaimers & Limitation of Liability
To the maximum extent permitted by law, the service is provided “as is” and “as available.” We disclaim all warranties (express or implied), including fitness for a particular purpose, accuracy, and non-infringement.
Seshly and its officers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for venue decisions, admission denials, policy changes, or user/venue conduct. Our total aggregate liability for any claim will not exceed the amount you paid to us for the specific digital service at issue.
12. Indemnification
You agree to defend, indemnify, and hold harmless Seshly from any claims, damages, liabilities, costs, and expenses arising out of your use of the service, your content or actions, your violation of these terms or applicable law, or disputes between you and any venue or third party.
13. Governing Law & Jurisdiction
These terms are governed by the laws of Spain. Exclusive jurisdiction for disputes lies with the courts of Spain. If a provision is found unenforceable, the remainder remains in effect.
14. Changes
We may update this page to reflect legal, operational, or product changes. We will post the effective date above and, where appropriate, provide additional notice.
